Sachikumar, learned counsel appearing for the petitioners; Mr. Shyam Sharma, learned GA appearing for the respondents No. 1 to 4 and Mr. LN Ngamba, learned counsel appearing for the respondents No. 5 to 8. [2] At the outset, the learned counsel appearing for the petitioners submitted that for redressing the grievances raised by the petitioners in the present writ petition, the petitioners have already approached the DC/ District Collector/ CALA, Thoubal District, Government of Manipur (respondent No. 2 herein), by submitting a representation dated 24-11-2025 and the said representation is still pending for consideration and disposal by the respondent No. 2. The learned counsel further submitted that the petitioners will be satisfied for the time being if the present writ petition is disposed of by directing the respondent No. 2 to consider the said representation on its own merit and strictly in terms of the applicable law and to dispose of the same by issuing a speaking order within a stipulated period. The learned counsel further submitted that pending consideration and disposal of the said representation submitted by the petitioners, the DC may be directed not to release the compensation amount in respect of the land in question. [3] Mr. Shyam Sharma, learned GA and Mr. LN Ngamba, learned counsel appearing for the respondents fairly submitted that as the prayer made on behalf of the petitioners is confined to the consideration and disposal of the representation submitted by them, -4- MC(WP(C)) No. 362 of 2026 & ors. Contd…/- they have no objection in disposing of this writ petition as prayed for by the learned counsel appearing for the petitioners. It has, however, been submitted by the learned counsel appearing for the respondents that at the time of consideration of the said representation and before disposal of the same, the DC may be directed to give notice to the respondents No. 5 to 8 inviting them to file any objection and also to give an opportunity of being heard to them at the time of consideration and disposal of the said representation. [4] Considering the submissions made by the learned counsel appearing for the parties, this court is of the view that it will be in the interest of justice to issue the following directions:- (i) The DC/ Competent Authority Land Acquisition (CALA), Thoubal District, is hereby directed to consider the aforesaid representation dated 24-11-2025 submitted by the petitioners on its own merit and strictly in terms of the applicable law and to dispose of the same by issuing a speaking order; (ii) The respondent No. 2 is further directed to give notice to the petitioners as well as the respondents No. 5 to 8 and to give them a reasonable opportunity of being heard at the time of consideration and disposal of the said representation; (iii) It is made clear that the whole process should be completed within a period of three months from the date of receipt of a certified copy of this order; -5- MC(WP(C)) No. 362 of 2026 & ors. Contd…/- (iv) The learned DC is also directed not to release the compensation amount in respect of the land in question till the disposal of the said representation; and (v) It is also made clear that the aforesaid directions have been issued without considering the merit of the present writ petition.
