1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.313/2025 registered at Police Station – Gaurela, District - Gaurela-Pendra- Marvahi (C.G.) for the offences punishable under Sections 296, 109(1), 189(1), 190,115(2) & 3(5) of the BNS.
2. The prosecution case, in brief, is that on 02/11/2025, the complainant Asif Ansari has lodged a report to the effect that on 02/11/2025 at 06:30 VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.08.25 10:43:38 +0530
2 pm, he was sitting in his friend's pickup in front of the shop on Venkatnagar Road Sultania, when accussed and others came in an auto from Gaurela side and accussed got him out of the pickup and started beating him with a stick due to old enmity started beating him with sticks, hands, and while abusing his mother and sister, Due to the beating, he had injuries on his head and both hands from which blood was flowing that the accused with intent to harm complainant image stopped the complainant when she was going somewhere, in night abused and try to outrage her modesty.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the instant case out of malice and with an intention to harass the applicant and his family members. It is further submitted that there is no specific allegation or substantial evidence against the applicant and only omnibus allegations have been levelled against him. The applicant has clean antecedents and has never been involved in any criminal case previously. He is the sole caring member of his family and is responsible for the care and maintenance of his elderly parents, and his arrest would cause severe hardship to the family. The applicant is a law-abiding citizen and a permanent resident of the address mentioned in the cause title, and therefore, there is no likelihood of his absconding or tampering with the prosecution evidence. It is further submitted that the trial is likely to take considerable time and the applicant undertakes that he shall not influence, threaten, harass or mislead any prosecution witness.
Learned counsel further submits that the co-accused in the same crime has already been granted anticipatory bail by this Hon’ble Court in MCRCA No. 386/2026 and another co-accused has also been granted
3 bail by the learned Trial Court vide order dated 04.08.2026. The applicant is ready to furnish adequate security and abide by all the terms and conditions that may be imposed by this Hon’ble Court.
4. On the other hand, learned State counsel opposed the anticipatory bail application of the applicant.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, the submissions advanced by learned counsel for the parties, the nature of the dispute, and the material available on record, and further considering the fact that the similarly situated co-accused, namely Somil Kesarwani, has already been granted anticipatory bail by this Court in MCRCA No. 386 of 2026 vide order dated 13.03.2026, this Court is of the view that the present applicant is entitled to the benefit of parity. Accordingly, without expressing any opinion on the merits of the case, this Court deems it appropriate to grant anticipatory bail to the applicant.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Sahil Kaushik, on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each
4 and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
