And In Re : Safikul Mondal @ Chotan ... Petitioner. Mr. Kaushik Choudhury, Mr. Dwaipayan Panda ... For the Petitioner. Mr. Kallol Mondal, Ld. PP, Mr. Somnath Adhikary, Ms. Madhurai Sinha ... Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 57 bottles of Wincerex Cough Syrup and petitioner is in custody for two months. Although charge- sheet has been submitted, but since other accused persons are absconding, there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that petitioner was absconding for about two years. Having considered the quantum of seizure in the present case and there being no opportunity to commence the trial at present, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner viz., Safikul Mondal @ Chotan shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 3rd Court, Dakshin Dinajpur at Balurghat. If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Dakshin Dinajpur without prior permission of the learned Special Court. Additionally, the petitioner shall also meet with the Officer-in-Charge, Hili Police Station once in every ten days till further orders of this Court. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1722 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
