Petitioner has filed this contempt petition alleging willful disobedience of the order dated 21.8.2020 passed in WPC No.1590/2020. 2. Learned counsel appearing on behalf of respondent No.1 would submit that along with application for exemption from SYED ROSHAN ZAMIR ALI Digitally signed by SYED ROSHAN ZAMIR ALI 2 personal appearance of respondent No.1, he has annexed copy of panchnama and the order of the Tahsildar dated 1.3.2024 and perusal of which would show that the order passed by this Court in WPC No.1590/2020 dated 21.8.2020 has been complied with and the obstruction on the land has been removed for using it as approach road. 3. Learned counsel for petitioner submits that according to his instruction also, after filing of this contempt petition, the petitioner has got the approach road. He, however, submits that petitioner has not been given approach road from land bearing Khasra No.51. 4. Heard learned counsel for the respective parties and also perused the documents available in record of contempt petition. 5. From the panchnama as also order dated 1.3.2024 passed by the Naib Tahsildar, Balrampur it is apparent that the Naib Tahsildar has taken into consideration the documents placed before him and found that land bearing Khasra No.51 measuring 0.25 hectare is presently recorded in revenue record as ‘road’ (government land). Halka Patwari has also submitted report in this regard that non-applicants therein have encroached upon the land bearing Khasra No.51. Team of revenue officials visited the spot and the possession/encroachment made on the spot by non- 3 applicants were removed. It is also mentioned that non- applicants have removed the encroachment and also given undertaking that they will not again encroach upon the said land and accordingly, closed the proceeding. 6. In the aforementioned facts, I am of the considered view that there is substantial compliance of the order dated 21.8.2020 passed in WPC No.1590/2020 and therefore, I do not find any good ground to continue with this contempt proceeding any further. 7. Consequently, this contempt proceeding is dropped and contempt notice stands discharged. The contempt petition is closed. However, the petitioner will at liberty to take recourse of law if, for any reason, he still feels aggrieved with the order passed by the Tahsildar, Balrampur. Sd/- (Parth Prateem Sahu) Judge roshan/-
