Ms. Arushi Rathore Mr. Saswata Chatterjee. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody since 17th November, 2023. More than 2 years 9 months have passed and only 8 witnesses have been examined and the prosecution intends to examine 26 more witnesses in support of its case. Learned advocate for the State opposes the prayer for bail emphasising the manner in which the offence was committed. I have taken into account the period of detention of the present petitioner and the fact that there are 18 more witnesses proposed to be examined by the prosecution. Having considered that there is no possibility of the trial 2 being concluded very soon, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Sujit Singha shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Chanchal, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned trial court. Thus, CRM(M)1272 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
