(ORAL) Prayer in the present petition preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the ‘BNSS’) is for the grant of regular bail to the petitioner in case FIR No.0063 dated 14.06.2026 registered under Sections 21 and 22 of NDPS Act, 1985 at Police Station North, District Chandigarh. 2. Custody certificate dated 26.07.2026 filed in Court today is taken on record. 3. On 14.06.2026 at about 09:45 PM, two persons Nirmal and Nand Lal were apprehended. Nirmal was found to be in possession of a wax paper envelope containing 2.52 grams heroin, whereas the petitioner was found to be in possession of 1.31 grams of ‘ice’ drug. 4. On the last date of hearing, it had been submitted by learned counsel for the petitioner that the ‘ice’ drug alleged to have been recovered from the petitioner is normally methamphetamine for which two grams is the MANI KUMAR 2026.07.27 18:30 I attest to the accuracy and integrity of this document CRM-M-34924-2026 (O&M) -2- small quantity and the commercial quantity is 50 grams. On the said assertion, an adjournment had been requested by learned State counsel on the ground that FSL report had not been received. 5. Status report had been filed in the Registry, which is taken on record. As per the same, the ‘ice’ drug in possession of the petitioner was methamphetamine. Therefore, 1.31 grams which is alleged to have been recovered from the petitioner is a small quantity. 6. The petitioner is in custody for the last 01 month and 13 days. The antecedents of the petitioner are clean. Though investigation is still going on, the same will take a sufficiently long time. Keeping in view the fact that a small quantity of methamphetamine was recovered from the petitioner, no useful purpose would be served by keeping the petitioner in custody any longer. 7. In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate. 8.
