Learned counsel for the petitioner submits that the petitioner is challenging the impugned transfer order dated 06.08.2026, whereby he has been transferred from Government Higher Secondary School, Dhaneli, District Balod to District Kabirdham, without any administrative exigency. It is submitted that the petitioner had joined at his present place of posting on 27.11.2025 pursuant to the earlier transfer order, and the impugned transfer has been made within nine months, in violation of Clause 3.9 of the State Transfer Policy dated 05.06.2025. It is further submitted that the petitioner's wife is posted at Dhamtari and, as per the transfer policy, the husband and wife ought to be posted at the nearest possible place. Per contra, learned State counsel opposes the petition and submits that, in case the petitioner submits a representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy, the same shall be considered and decided in accordance with law. 3. I have heard learned counsel for the parties and perused the record. 4. Considering the nature of the grievance raised by the petitioner and the submission made by learned State counsel, without expressing any opinion on the merits of the case, the petitioner is directed to submit a representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy within a period of 10 days from today. In case such representation is submitted within the aforesaid period, the competent Transfer Committee shall consider and decide the same by passing a reasoned and speaking order, strictly in accordance with law and the applicable Transfer Policy, preferably within a period of 25 days thereafter. 5.
