This application under Article 227 of the Constitution is at the instance of the defendant no.1 praying for a direction upon the learned Civil Judge (Sr. Div.), 3rd Court at Howrah to dispose of the applications under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure and the application under Order XXXIX Rule 4 of the Code of Civil Procedure in T.S. No. 92 of 2010 expeditiously. Mr. Nag, learned advocate appearing for the petitioner submits that the said applications are otherwise ready for hearing and the written objections thereto have already been filed. From the order sheets appended to this application this Court finds that August 17, 2026 is the next date fixed before the learned trial judge. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite party

or the learned advocate representing the opposite party before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 1822 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 3rd Court at Howrah to take up the hearing of the applications under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure along with application under Order XXXIX Rule 4 of the Code of Civil Procedure, if the same are otherwise ready for hearing, and make an endeavour to dispose of the same as expeditiously as possible but positively within a period of 8 weeks from the next date fixed without granting any unnecessary adjournments to either of the parties. After disposal of the said application, the learned trial judge shall make an endeavour to dispose of the other pending applications as expeditiously as possible. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
