Mr. Ranojoy Chatterjee Mr. Swarnajit Das ….for the petitioner 1) At the time of call, learned advocate representing the petitioner prays for liberty to approach jurisdictional Magistrate under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 since complaint of petitioner is not taken into consideration by the concerned police authorities and appropriate steps have not been taken. 2) Considering availability of alternative remedy under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, writ petition is disposed of thereby granting liberty to petitioner to approach jurisdictional Magistrate in pursuit of remedy. 3) However, it is made clear that if jurisdictional Magistrate is approached, decision shall be taken in accordance with law without being influenced by order of this Court passed on this writ petition. 4) Parties to act on the server copy of this order duly downloaded from the official website of this Court.
