Rakib (Rejected) CRM (NDPS) 1659 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station case no. 76 of 2026 dated 14.01.2026 under Sections 21(c)/29 of the NDPS Act. And In the matter of : Sridam Ghosh ……Petitioner. Mr. Mritunjoy Chatterjee Mrs. Suchismita Chakraborty Mr. Arka Roy Mr. Debarnab Adhikary .....for the Petitioner. Mr. Suman Chakraborty ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is similarly placed as the other accused person namely, Manab Sarkar who has been granted bail in CRM (NDPS) 1650 of 2026. Learned advocate appearing for the State submits that although in the present case petitioner is similarly situated but there are five antecedents so far as the present petitioner is concerned. Memo of evidence has been submitted which reflects that two of the cases are under Section 302 of the Indian Penal Code and one of the case is under Sections 365/364A of the Indian Penal Code. Having considered the antecedents of the present petitioner, I am not inclined to release the petitioner on bail. 2 Petitioner will renew his prayer for bail after the evidence of seizure list witnesses are over. As such, prayer for bail of the petitioner in CRM (NDPS) 1659 of 2026 is rejected. Memo of evidence submitted by the State be kept with the record. A copy of the memo of evidence be handed over to the learned advocate appearing for the petitioner. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
