Versus The State of West Bengal Mr. Suman De. …for the petitioner. Mr. L. Vishal Kumar Mr. Sanjib Das. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 6 months and the subject matter of the case relates to alleged recovery of 25 bottles of Phensedyl Cough Syrup. Learned advocate for the State opposes the prayer for bail. Having considered the period of detention of the present petitioner and the charge-sheet reflects that prosecution intends to rely upon 13 witnesses in order to prove its case, I am of the view that some time will be required, as such, the petitioner be released on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Rashidul Sk. shall be released on 2 bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1732 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
