Heard on I.A. No. 03 in WPS No. 8515 of 2024, which is an application for taking document on record. 2. For the reasons mentioned in the application, the same is allowed. 3. Since both the writ petitions arise out of the petitioner's deputation and the subsequent orders concerning his continuation, repatriation and posting of Respondent No.5 in WPS No. 4736/2026, they are being heard together and are being disposed of by this common order. For the sake of convenience, the facts and documents of WPS No. 8515 of 2024 are being referred to. 4. By way of WPS No. 8515 of 2024, the petitioner has challenged the order of repatriation dated 13.12.2024 (Annexure P/1), whereby he was directed to join at his parent place of posting. 5. Learned counsel appearing for the petitioner submits that, though various grounds have been raised challenging the order of repatriation 3 dated 13.12.2024, during the pendency of the writ petition this Court vide interim order dated 06.01.2025, the petitioner was permitted to continue on deputation on the post of Deputy Secretary and was accordingly working as such. He further submits that, after expiry of the period of two years of deputation, Respondent No.4, vide order dated 05.06.2026, posted respondent No.5 at the place where the petitioner was then continuing on deputation pursuant to the interim order passed in WPS No. 8515 of 2024, which was subsequently challenged by the petitioner in WPS No. 4736/2026. 6. Learned counsel further submits that, even in WPS No. 4736 of 2026, this Court has granted interim protection in favour of the petitioner against the aforesaid order dated 05.06.2026. He submits that, in view of the subsequent developments and the expiry of the period of deputation, the grievance of the petitioner may appropriately be considered afresh by the competent authority. He, therefore, prays that both the writ petitions may be disposed of by directing the competent authority to consider the case of the petitioner regarding his further deputation/continuation and posting, after affording him an opportunity of hearing, and to take an appropriate decision in accordance with law within a stipulated period. 7. Learned State Counsel does not oppose the aforesaid submission. He submits that, since the period of deputation of the petitioner has already come to an end, the competent authority may be permitted to take a fresh decision with regard to the petitioner's further deputation/continuation and posting, after affording an opportunity of hearing to the petitioner and in accordance with law. 4 8. Having considered the submissions made by learned counsel for the parties and having regard to the subsequent developments which have taken place during the pendency of the writ petitions, particularly the petitioner's continuation on deputation pursuant to the order dated 06.01.2025, the subsequent expiry of the period of deputation and the order dated 05.06.2026 i.e. posting of respondent No. 5 at the place of the petitioner was working on the basis of interim order passed in WPS No. 8515/2024, this Court is of the view that the matter may appropriately be considered afresh by the competent authority. 9. Accordingly, both the writ petitions are disposed of with liberty to the petitioner to submit a representation before the competent authority with regard to his further deputation/continuation and posting. In the event the petitioner submits such representation within a period of five days from today, the competent authority shall consider the same, after affording an opportunity of hearing to the petitioner, and shall take an appropriate decision in accordance with law and pass a fresh order. The aforesaid exercise shall be completed within a period of fifteen days from the date of receipt of the representation. 10. It is made clear that this Court has not expressed any opinion on the merits of the respective claims of the petitioner, and the competent authority shall take an independent decision in accordance with law. 11.
