1. Affidavits of service filed in Court today are taken on record. 2. The petitioner’s prayer for grant of post graduate scale of pay was allowed by the District Inspector of Schools, South 24 Parganas vide order dated 18th December, 2015 with effect from 14th July,
2006. Submission of the petitioner is that the post graduate scale of pay was, however, disbursed from 1st August, 2016. 3. Submission of the petitioner is that she ought to have been paid post graduate scale of pay with effect from 14th July, 2006 till 31st July, 2016. 4. The school where the petitioner is currently serving forwarded all the necessary papers and documents to the Additional District Inspector of Schools, Secondary Education, Diamond Harbour Sub-Division for payment of arrear salary of the petitioner amounting to Rs. 2,12,250/- way back in April, 2023. The same has not been acted upon by the authority till date. Page 2
5. Prayer has been made to direct the DI to disburse the arrear salary along with interest. 6. As it appears that the petitioner has already been found to be eligible to receive the post graduate scale of pay on and from 14th July, 2006, accordingly, the petitioner would be entitled to all arrears which have not been paid to her. 7. The school has calculated the arrears and forwarded the same to the Additional District Inspector of Schools. 8. The instant writ petition is disposed of by directing the District Inspector of Schools, Secondary Education, Nadia and Additional District Inspector of Schools, Secondary Education, Diamond Harbour Sub-Division being the respondent nos. 3 & 4 herein to take immediate steps for releasing the arrear salary of the petitioner. 9. As the petitioner would be receiving her dues after a considerable delay, the arrear should be released along with interest calculated at the rate of six percent per annum payable on and from the due date till the date of actual payment. 10.
Steps shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order. 11. The writ petition stands disposed of. 12. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 13. Certified copy of the server copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
