The dispute between petitioners and respondents No. 5 apparently relates to ownership and possession of land and is primarily civil in nature. Writ jurisdiction cannot be invoked where disputed questions of facts are involved. No particulars have been disclosed either in the petition or in the representation Annexure P-12, when, where and in what manner, respondent No.5 extended life threats and threat to throw the petitioners out of their property. Considering the nature of dispute, the Court is not inclined to issue any writ in the nature of mandamus under Article 226 of Constitution of India, as no threat to life and liberty of petitioners is perceived. Appropriate course for the petitioners is to avail their remedy in the competent Civil Court, in accordance with law. 5. Disposed of. All the pending miscellaneous applications, if any, stand disposed of.
