This is the second bail application filed under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with SAURABH YADAV Digitally signed by SAURABH YADAV Date: 2026.08.25 16:16:10 +0530 2 Crime No. 93/2026 registered at Police Station – Modhapara, District Raipur (C.G.), for the offence punishable under 297, 119(1), 115(2) and 3(5) of BNS. 2. First bail application of the applicant was rejected on merits vide order dated 10.07.2026 passed in MCRC No. 6144 of 2026. 3. As per the brief facts of the prosecution case, the allegation against the applicant/accused and the co-accused is that they demanded money from the complainant for consuming liquor. Upon the complainant's refusal, they abused him in filthy language and assaulted him with fists and blows. It is further alleged that the present applicant assaulted the complainant with a pair of scissors kept in his possession, causing injuries on his abdomen, left waist and ribs. When the complainant's mother intervened to rescue him, the applicant allegedly attacked her with the same scissors, causing injuries to her right wrist and left thigh. During investigation, the scissors allegedly used in the commission of the offence were recovered and seized by the police at the instance of the applicant. Accordingly, the offence have been registered and the applicant has been arrested. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. 3 It is contended that the applicant has not committed the alleged offence and has been implicated due to previous enmity. He further submits that the charge-sheet has already been filed and that the applicant has been in custody since 26.05.2026. The conclusion of the trial is likely to take some time; therefore, learned counsel prays for grant of bail. 5. Learned State counsel opposes the bail application and submits that charge-sheet has been filed before the competent Court. 6. I have heard learned counsel for the parties and perused the material available on record. 7. Considering the facts and circumstances of the case, the gravity of the offence, the submissions made by learned counsel for the parties, the allegations levelled against the applicant, and the fact that the applicant's first bail application was already rejected on merits vide order dated 10.07.2026 passed in MCRC No. 6144 of 2026, and no new ground has been raised in the present second bail application, I am not inclined to grant bail to the applicant. 8. Accordingly, the second bail application of applicant – Anand @ Tapan Bharti involved in Crime No. 93/2026 registered at Police Station – Modhapara, District Raipur (C.G.), for the offence punishable under 297, 119(1), 115(2) and 3(5) of 4 BNS, is rejected. 9.
