Accused in S.C.No.591 of 2025 pending before the Court on LXVII Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.33 of 2025 registered by Adugodi Police Station, Bengaluru City for the offence punishable under Section 108 of BNS, 2023 is before this Court in the petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.33 of 2025 was registered by Adugodi Police Station, Bengaluru City initially for the offence punishable under Section 226 of BNS, 2023 against the petitioner, based on the first information dated 27.01.2025 received from Sri Ananda, who is the deceased in the present case. It appears that Ananda, who had suffered serious injuries in the incident that had taken place on 09.01.2025, was admitted to hospital and he had died on 28.01.2025 while undergoing treatment. Subsequently, petitioner was arrested on 28.01.2025 and remanded to judicial custody. Bail application filed before the Trial Court in S.C.No.591 of 2025 was rejected on 19.08.2025. Therefore, she is before this Court. 4. Petitioner is the wife of deceased Ananda. Their marriage was performed about 7 years prior to the date of registration of FIR in the present case. From the said wedlock, 3 children were born to the couple. In the charge sheet it is alleged that, the petitioner, by suppressing her earlier marriage had married the deceased. It is also alleged that, she had left her last son Charan with CW4 who is her relative and had refused to bring him back, in spite of request made by her husband. It is under these circumstances, on 09.01.2025, CW1 -Ananda has attempted to commit suicide by pouring petrol on himself and lighting fire. Injured Ananda was admitted to Victoria hospital immediately thereafter and on 27.01.2025, FIR was registered in the present case against the petitioner for offence punishable under Section 226 of BNS, 2023. Subsequently, on 28.01.2025, Ananda had died in a hospital while undergoing treatment and thereafter, offence punishable - 4 - HC-KAR CNR: KAHC010525332026 NC: 2026:KHC:42892 CRL.P No. 11510 of 2026 under Section 108 of BNS, 2023 has been invoked in the present case. 5. Petitioner is a lady who is in custody for the last more than 1 year six months. All the material charge sheet witnesses have been already examined in the present case. Post mortem report of deceased would go to show that, death is due to 'Septicemia, consequent to burn injuries sustained'. She has got three minor children to be taken care of. Under the circumstances, the following: ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.591 of 2025 pending before the Court on LXVII Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.33 of 2025 registered by Adugodi Police Station, Bengaluru City for the offence punishable under Section 108 of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh - 5 - HC-KAR CNR: KAHC010525332026 NC: 2026:KHC:42892 CRL.P No. 11510 of 2026 only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts her appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against her is disposed off.
