And In the matter of : Abbas Mondal. ……Petitioner. Mr. Sandip Chakraborty Mr. Amanul Islam Mr. Sourav Mukherjee Mr. Kaustav Das .....for the Petitioner. Mr. Parmanand Sharma, Ld. APP Mr. Soumya Raha ……for the State. Learned advocate appearing for the petitioner submits that the petitioner was present at a particular railway station and the prosecution case itself would reflect that the contraband was being carried by another accused person. Petitioner subsequently has been alleged to be shown as a prospective recipient of the said contraband. Learned advocate further submits that petitioner is in custody for one year eight months, two witnesses have been examined and the evidence of the 3rd witness is in progress. Learned advocate appearing for the State opposes the prayer for bail, produces the Case Diary and submits that few more witnesses are to be examined by the prosecution. In view of the period of detention of the present petitioner, I am of the opinion that another six months time is afforded to the 2 prosecution. In case prosecution witnesses are not completed within the aforesaid six months, learned trial Court would be at liberty to release the petitioner on bail on such terms and conditions as it deems fit and proper for ensuring further appearance of the petitioner. At this stage, CRM (NDPS) 1531 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
