Adv. Rudranil De, Adv. Soumo Charan, …for the petitioner. Adv. Tapasi Palit Sinha, Adv. Suman Chattopadhyay, …for the State.
Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. Pursuant to work orders issued by the Assistant Engineer, Raghunathpur Sub Division, the petitioner completed the work allotted to him and submitted bills for the same. He seeks disbursal of the amount due. It appears from the report submitted by the State that the bills have been prepared by the Executive Engineer, Purulia Division, Public Health Engineering Directorate, being the 6th respondent herein, and sent to the Principal Secretary, Public Health Engineering Department, being the 1st respondent herein, for allotment of fund for early disbursal of the amount. In view of the above, the first respondent is directed to disburse the amount raised in the bills to the 6th respondent within four weeks from the date of communication of this order. The 6th respondent shall disburse the said amount to the petitioner within a week thereafter. The writ petition is accordingly disposed of. There shall however, be no order as to costs.
2 Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
