The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.278/2025, registered at Police Station Shivarinarayan, District Janjgirj Champa (C.G.) for alleged KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.08.26 15:51:50 +0530
2 commission of offence punishable under Section 20 (b) of the NDPS Act.

As per the case of the prosecution, on 22.7.2025, the concerned Police has received information from the informant that accused Adarsh Sahu is smuggling 13.335 kg of Ganja valued at Rs.1,30,000/- and thereafter the concerned police conducted a raid and seized the said Ganja from the spot. Thereafter FIR was registered. Hence, the bail application.

Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case. He further submits that the applicant is minor and nothing has been seized from the present applicant. The case of main accused Adarsh Sahu is pending before the concerned Special Judge, NDPS in which the said accused has been released on regular bail, and the case of the applicant/juvenile is not different from that of the main accused. Therefore, on the ground of parity, anticipatory bail may be granted to the applicant/juvenile.
4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that after recovery the present applicant remained absconding and, therefore, the anticipatory bail application of the applicant deserves to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.

6. Considering the submissions of learned counsel for the parties and the fact that after recovery the present applicant remained absconding, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant - ABC, involved in Crime No.278/2025, registered at Police Station Shivarinarayan, District Janjgir Champa (C.G.) for alleged commission of offence punishable under Section 20 (b) of the NDPS Act, is rejected.
