Petitioner has filed this writ petition seeking following reliefs:- “10.1 That this Hon’ble Court may kindly be pleased to issue a suitable writ or writs for directing the respondent authorities PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 especially respondent No. 4 to grant promotion to the petitioner on the post of Assistant Grade-II from the post of Assistant Grade-III w.e.f. 27.02.2021 since when the respondent No. 6 has been promoted on the said post. 10.2 Any other relief/ reliefs which may deem fit and proper in the facts and circumstances of the case, may also be allowed.” 2. Learned counsel for the petitioner submits that petitioner is working on the post of Assistant Grade-III, after completion of requisite period of service on the said post, petitioner became eligible for his promotion on the post of Assistant Grade-II. Respondent- department has initiated the proceedings for promotion of Assistant Grade-III to the post of Assistant Grade-II, however, petitioner was not given promotion but junior (Respondent No. 6) to petitioner in the gradation list has been promoted. Aggrieved with which, petitioner has submitted representation on 20.01.2026 before Respondent No. 4, which is pending consideration and therefore direction be issued to Respondent No. 4 to take decision on the pending representation at the earliest within specified time. 3. On the other hand, learned counsel for the Respondents/State submits that she is having no objection to the limited prayer made by the counsel for petitioner. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without observing anything on 3 / 3 merits of case, this writ petition at this stage is disposed of directing Respondent No. 4 to consider and take decision on the representation submitted by petitioner dated 20.01.2026, in accordance with law, expeditiously, preferably within a period of 02 months from the date of receipt of certified copy of order passed by this Court. 6.
