Ct. 652 tbsr
CO 4086 of 2025
SOLEMAN MONDAL AND ORS VS ASRAB ALI @ ASRAF ALI
Mr. Golam Karim Chowdhury Md. A. Alam
....for the petitioners
1. The petitioners have filed the instant revision seeking a direction upon the learned Trial Court for a time-bound disposal of their application before the same, under Order 7 Rule 11 read with Section 151 CPC.
2. From submissions made before this Court by the learned advocate for the petitioners as well as from the records, it transpires that the petitioners/defendants filed their application under Order 7 Rule 11 read with Section 151 CPC for rejection of the plaint in connection with Title Suit No. 982 of 2023, in the learned trial Court on November 29, 2023.
3. Record reveals that since thereafter the Court has time and again adjourned the proceedings in the suit for one ground or other, resulting in not taking up that
2 application of the present petitioners for hearing, even for once, till date.
4. In the interregnum about three years have elapsed.
5. According to this Court, this is an inordinate and extraordinary delay in disposing of an application filed by a party before the Court under Order 7 Rule 11 read with Section 151 CPC.
6. Hence, let this revision be disposed of with a direction upon the learned Trial Court to take up the petitioners/defendants’ application under Order 7 Rule 11 read with Section 151 CPC dated November 29, 2023, for hearing and disposal, in presence of all the parties before it, maximum within a period of six weeks from the date of communication of copy of this order.
7. For this reason, the learned Trial Court shall not grant any unnecessary adjournment to any of the parties, unless it is satisfied about a cogent and sufficient reason to be there for such adjournment.
8. In view of the facts and circumstances of the present case, I do not find any requirement
3 for directing service of a copy of this revision application upon the opposite party.
9. The Instant revision is disposed of with the direction as above.
10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
