KAMAL ORAL ORDER The petitioner is before this Court questioning the order dated 26.06.2018 passed by the first respondent cancelling the caste certificate issued in favour of the petitioner on 31.10.2014, 29.02.2016 and 07.06.2016. It is contended that the order impugned does not satisfy the - 3 - HC-KAR CNR: KAHC010482532022 NC: 2026:KHC:40445 WP No. 21156 of 2022 requirement of Rule 4 of the Karnataka Scheduled Castes, Scheduled Tribes and other Backward Classes (Reservation of Appointment, etc) Rules, 1992 (Rules, 1992 for short). Inasmuch as the said Rule envisages the order to be passed and signed by all the members contemplated thereunder, whereas, the impugned order is signed only by the Deputy Commissioner. On this account alone, it is submitted that the impugned order is required to be set aside. 2. The learned Special Counsel appearing for the respondents - Authority fairly submits that there is non- compliance with the statutory requirement contemplated under Rule 4 of Rules, 1992. Therefore, he submitted that the matter be remitted to the Commission for fresh consideration. 3. Impugned order at Annexure - A is quashed. Matter is remitted to the first respondent - Commission. The committee shall after affording an opportunity to the parties, pass appropriate orders strictly in compliance with the Rule noted above.
