Ahmed …for the petitioners This application under Article 227 of the Constitution of India is at the instance of the added respondent praying for a direction upon the learned Civil Judge (Jr. Division) 3rd Court at Alipore, South 24 Parganas to dispose of Title Suit No. 139 of 1994 expeditiously. Learned advocate appearing for the petitioners submits that July 13, 2026 was fixed for further cross-examination of DW-1. He further submits that the opposite-party nos. 1 to 5 herein have filed an application being CAN 1 of 2025 praying for recalling of the order dated May 5, 2025. He submits that the said application is still pending. In the light of the submission made by the learned advocate appearing for the petitioners this civil revision application stands disposed of by requesting the learned Civil Judge (Jr. Division) 3rd Court at Alipore, South 24 Parganas to take up the hearing of the Title Suit No. 139 of 1994 for further 2 cross-examination of DW-1 and to make an endeavour to dispose of Title Suit No. 139 of 1994 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
