IN THE HIGH COURT OF ORISSA AT CUTTACK
WP(C) No.10113 of 2026
Pravakar Rout …. Petitioner Mr. S. Samal, Advocate -versus- State of Odisha, represented through its Principal Secretary, Revenue and Disaster Management Department and Others …. Opposite Parties Mr. G. Tripathy, AGA
CORAM:
SHRI JUSTICE B. P. ROUTRAY
ORDER 8.4.2026
Order No.
01.
1. Heard Mr. S. Samal, learned counsel for the petitioner and Mr. G. Tripathy, learned AGA for State – opposite parties.
2. The petitioner has prayed to set aside the notice dated 23rd March, 2026 under Annexure-2 with further direction to the opposite parties to conduct fresh re-assessment of the petitioner’s property including the structures and trees standing over plot No.2621.
3. Admittedly plot No.2624 does not belong to the petitioner and therefore, the IDCO authorities have issued notice as per Annexure-2 for eviction of the petitioner alleging encroachment of the same by him.
4. Having gone through the averments made in the writ petition, nothing is found to satisfy that the petitioner has any right to encroach over plot No.2624. Accordingly the writ petition is dismissed.
