1. Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- 10.1 Issue an appropriate writ, order or direction, for quashing the order dated 05.12.2025 (Annexure P/1) passed by the
2 learned Tahsildar Pipariya, District Kabirdham (C.G.) / Respondent No. 4, as being arbitrary, non speaking, unconstitutional, and in violation of principles of natural justice. 10.2 Issue an appropriate writ, order or direction, directing the respondent authorities not to take any coercive or demolitory action against the Petitioner in respect of the land beaing Khasra No. 362, admeasuring 0.223 hectares, situated at Village Bhopalbhawna, Tahsil Pipariya, District Kabirdham, without first conducting a lawful demarcation in accordance with law and without due adjudication. 10.3 Issue an appropriate writ and/or issue a direction to Respondent No. 03/S.D.O. (R.) to decide the Petitioner’s pending appeal and application under Section 52 of the Chhattisgarh Land Revenue Code within a stipulated time- frame, in accordance with law. 10.4 Pass any other order(s) as this hon’ble Court may deem fit and proper in the interest of justice, equity, and good conscience with cost of this petition.
2. Perusal of pleading of petitioner as well as relief sought for by him shows that by filing instant writ petition, petitioner has challenged the order dated 05.12.2025 passed by Naib Tahsildar, Pipariya, District Kabirdham (C.G.), such

order can be assailed by the petitioner by way of filing appeal under section 44 (1) of the Chhattisgarh Land Revenue Code, 1959 before Sub Divisional Officer (Revenue), Kawardha, which the petitioner has already filed on 09.12.2025 as per Annex. P-4.
3. Thus, the petitioner has already availed the remedy available to him under the provisions of CG Land Revenue Code, 1959, therefore, this Court is not inclined to entertain instant writ petition invoking extraordinary jurisdiction of this Court.
