The instant petition has been filed by the petitioner for grant of regular bail in case arising out of FIR No.117, dated 13.12.2024, registered under Sections 103(1), 109, 191(3), 190 and 238 of the BNS, at Police Station Sadar Gurdaspur, District Gurdaspur. 2. The petitioner along with co-accused is facing trial for commission of the aforementioned offences on the allegations that on 13.12.2024, by forming membership of an unlawful assembly, he had caused injuries to Surjit Singh, leading to his death. 3. It is argued by learned counsel for the petitioner that he has been falsely implicated in this case. He is in custody for a period of over 01 year and 04 months. The complainant and material witnesses have since been examined before the trial Court and have not implicated the petitioner HARJEET KAUR 2026.07.27 18:31 I attest to the accuracy and integrity of this document CRM-M-30663-2026 (O&M) -2- or other accused in commission of subject offences. On account of this fact and further taking into consideration the period of his incarceration as well as the fact that the trial will take time to conclude, he has a reason to seek concession of bail. It is, thus, argued that the petition deserves to be allowed. 4. Per contra, learned State counsel, while relying upon the status report has argued that taking into consideration the gravity of the allegations as levelled against the petitioner, he does not deserve to be extended the benefit of bail. 5. This Court has heard the rival submissions made by learned counsel for the parties. 6. The complainant - Sandeep Kaur has been examined. Copy of her sworn deposition has been placed on record as Annexure P-4 and a perusal of the same reveals that she did not implicate the petitioner or any other accused in the commission of offence of murder of her father and deposed that her father had sustained injuries at the hands of some unknown persons. She is shown to have resiled from her previous statement. The copies of statements of two more witnesses, namely, PW2 Surinder Singh and PW3 Gurwinder Singh have also been placed on record, who too have not supported the prosecution version for involvement of the petitioner in the murder of the victim. As such, it emerges from the record that neither of the eye witnesses have supported the prosecution version. Taking into consideration the nature of the evidence, which has come on record in the form of testimonies of material witnesses, the period spent by the petitioner in custody and coupled with the fact that chances of conclusion of trial in near future are bleak, this Court is of the considered opinion that further HARJEET KAUR 2026.07.27 18:31 I attest to the accuracy and integrity of this document CRM-M-30663-2026 (O&M) -3- incarceration of the petitioner would not serve any fruitful purpose. Keeping in view the above discussion, this Court is of the considered opinion that a case is made out for grant of bail to the petitioner. Accordingly, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing personal as well as surety bonds to the satisfaction of learned trial Court/CJM/Duty Magistrate concerned. 7. It is clarified that the observations made above shall not be construed as an expression of opinion of this Court on the merits of the case and shall not influence the outcome of the trial in any manner. 8. Since the main petition has already been disposed of, pending application, if any, is rendered infructuous.
