In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Polba Police Station case no. 143 of 2020 dated 22.09.2020 under Sections 366A/370/370A/372/373/376/120B of the Indian Penal Code read with Sections 3/4/5/6/7/8 of the Immoral Trafficking (Prrevention) Act, read with Sections 4/6/8/12/17 of the POCSO Act, 2012.
And In the matter of : Mithu Mondal
……Petitioner. Mr. Sandeep Prasad Shaw Mr. Subhadipp Pan Mr. Aman Kumar Singh Mr. Bishal Ghosh
.....for the Petitioner. Mr. L. Vishal Kumar
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for nine months and was not named in the FIR, as such she has been arrested all on a sudden. Learned advocate claims innocence of the petitioner and prays for bail. Learned advocate appearing for the State has produced the Case along with the statement of the victim. Having considered the overall circumstances including the fact that petitioner was absconding for a period of five years and her complicity is reflected in the statement of the victim, I am not inclined to release the petitioner on bail in serious offences of trafficking and sexual assault of minor girls. Thus, CRM (M) 859 of 2026 is dismissed.
