JUSTICE D K SINGH) 1. The present writ petition has been filed impugning the award dated 22.01.2021 passed by the Central Government Industrial Tribunal-cum-Labour Court (CGIT) dated 22.01.2021 in CR No.03/2011. 2. The respondent, who was working as an Accounts Clerk in the Zonal Office of the petitioner-Bank, was proceeded with domestic enquiry for certain charges. The Enquiry Officer found the charges proved against the respondent and the Disciplinary Authority imposed the punishment of dismissal from service. 3. The CGIT, vide impugned award, though recorded the finding that the respondent had withdrawn Rs.20,000/- loan amount sanctioned to one customer, but held that the stray act - 3 - HC-KAR CNR: KAHC010159352021 NC: 2026:KHC:44298-DB WP No. 7930 of 2021 of irregular withdrawal of amount by the respondent would not be a grave misconduct liable for capital punishment of dismissal from service. 4. We are not very convinced with the findings and reasoning in the award. But, considering the fact that the respondent had attained the age of superannuation in the year 2019, we reduce the back wages from 50% to 25%. Let the amount be re-calculated and paid to the respondent within two months from today. 5. With the aforesaid, the writ petition stands disposed of.
