Heard the parties.

By filing this writ petition, the petitioners have prayed to issue an appropriate order in the nature of mandamus directing upon the respondent particularly respondent No.3, to issue the raiyati manyata certificate in respect of piece of land measuring an arear of 1.52 acre, pertaining to Plot No.584 under Khata No.128, in Moza Chiaki, in the District of Palamu.

It is the case of the petitioners that the proceeding is pending before respondent No.3 and the respondent No.3 demanded documents and title of the land to enable issuance of the aforesaid certificate but till date, no final order has been passed.

The learned counsel for the petitioners submits that suffice it would be if a direction is given to the respondent No.3 to take a decision on the application of the petitioners by passing a reasoned order, if not taken.

Learned counsel appearing on behalf of the respondents submits that if till date, a decision has not yet been taken, the same will be taken at the earliest.

Considering the said submission, I direct the respondent No.3 to consider the case of the petitioners as per law

and pass an appropriate order within a period of eight weeks, after hearing all the parties concerned. If on conclusion of hearing, it is decided to issue a certificate as desirable by the petitioners, the respondents will issue the same. If for any reasons, the petitioners’ claim is rejected, the grounds for such reason should also be communicated to the petitioners.

The entire process should be concluded within a period of 12 weeks from the date of receipt of a copy of this order.

With the aforesaid observations, this writ petition stands disposed of.
