JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in Crime No.109/2026 registered by Koratagere Police Station, Tumkuru for the offences punishable under Section 310(4) and 310(5) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.109/2026 was registered by Koratagere Police Station, Tumkuru for the aforesaid offences against 6 unknown persons, based on the first information dated 14.05.2026 received from Theerthesha Y.G., Police Officer attached to Koratagere Police Station. In the said case, the petitioner was arrested on - 3 - HC-KAR CNR: KAHC010412252026 NC: 2026:KHC:39854 CRL.P No. 8722 of 2026 14.05.2026 and subsequently remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5181/2026 was rejected on 04.06.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner submits that the petitioner was arrested in the present case. He was also implicated in Crime No.107/2026 registered by the very same police station for offence punishable under Section 309(4) of BNS, 2023. Except the aforesaid two cases, the petitioner has no other criminal antecedents. He has been falsely implicated in the present case. Accordingly, prays to allow the petition. 5. Per contra, learned HCGP who has opposed the petition submits that investigation of the case is under progress. Accordingly, prays to dismiss the petition. 6. In the first information dated 14.05.2026 submitted in the present case, the first informant, who is a police officer has stated that he had received credible - 4 - HC-KAR CNR: KAHC010412252026 NC: 2026:KHC:39854 CRL.P No. 8722 of 2026 information on the said date at about 07.00 p.m. that about 5 to 6 persons, armed with weapons were preparing themselves to commit dacoity. Based on such information, a raid was conducted to the alleged place, where the accused persons were preparing to commit the crime and the petitioner was apprehended from the said spot along with the other accused and remanded to judicial custody. It appears that based on his confession statement recorded in the present case, he is also arrayed as an accused in Crime No.107/2026 registered by the very same police station for the offence punishable under Section 309(4) of BNS, 2023. Insofar as the present case is concerned, major portion of the investigation is completed and the alleged offences are not punishable with death or life imprisonment. Petitioner aged 20 years, is in custody for the last more than 2 months. 7. Under the circumstances, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively and he shall be released from jail if - 5 - HC-KAR CNR: KAHC010412252026 NC: 2026:KHC:39854 CRL.P No. 8722 of 2026 his custody is not required in any other case, subject to following conditions. O R D E R The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.109/2026 registered by Koratagere Police Station, Tumkuru for the offences punishable under Section 310(4) and 310(5) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR CNR: KAHC010412252026 NC: 2026:KHC:39854 CRL.P No. 8722 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
