JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned AGA accepts notice for respondent Nos.1 to 4. 2. The petitioners are before this Court seeking for the following reliefs: "a) Issue a Writ in the nature of Mandamus or any other appropriate writ, order, or direction, directing the 4th Respondent, the Sub-Registrar, Hunsur Taluk, Mysore District, to register the Sale Deed in favour of the Petitioners in respect of the schedule properties, in strict compliance with the judgment and decree dated 30.08.2000 passed in O.S. No.18/1996 by the Court of the Civil Judge, (Jr.Dn) and J.M.F.C., Hunsur, as per Annexure-A as confirmed by the First Appellate Court in R.A. No.54/2000 as per Annexure-B and as finally affirmed by the Hon'ble Supreme Court of India in Civil Appeal No. 1402 of 2024 by its order dated 30.01.2024, as per Annexure-D without insisting on the production of an 11E sketch, upon the Petitioners complying with all other statutory requirements. b) Pass such other and further orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice and equity." 3. The petitioners are aggrieved by the demand made by the respondents for furnishing of a 11E sketch for - 4 - HC-KAR CNR: KAHC010548212026 NC: 2026:KHC:42646 WP No. 25059 of 2026 the purpose of registration of a sale deed in terms of a judgment and decree passed in O.S. No.18/1996 by the Civil Judge, Junior Division and JMFC, Hunsur on 30.08.2000, confirmed by the First Appellate Court in R.A. No.54/2000 and affirmed by the Hon'ble Supreme Court of India in Civil Appeal No.1402/2024, vide its order dated 30.01.2024 except for a direction to make payment of additional amount of Rs.1,00,000/-. 4. This Court has in a catena of decision held that when a sale deed is presented in terms of decree passed by the Court, there would not be a requirement of furnishing 11E sketch. Such being the situation, respondent No.4 could not have insisted upon the furnishing of 11E sketch. 5. Though learned AGA submits that the requirement of furnishing 11E sketch is for the property owner to identify the property and to avoid future litigation, - 5 - HC-KAR CNR: KAHC010548212026 NC: 2026:KHC:42646 WP No. 25059 of 2026 that aspect is left to the discretion of the petitioner. Hence, this Court passes the following: O R D E R (i) Writ petition is allowed. (ii) A mandamus is issued directing respondent No. 4 to register sale deed as prepared by the Executing Court and made available for registration without insisting for 11E sketch on the date on which it is presented for registration. (iii) It is made clear that the registration of the sale deed shall not in any manner amount to verification or identification of boundaries that is at the sole risk of the petitioner.
