This first anticipatory bail application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.82/2026 registered at Police Station – Nawagarh, District – Janjgir Champa (C.G.) for the offence punishable under KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.08.18 19:43:37 +0530 2 Sections 296, 115 (2), 351 (3), 191 (2), 191 (3) & 109 of Bharatiya Nyaya Sanhita (for short ‘BNS’). 2. The prosecution story, in brief, is that on 3.3.2026, complainant Jagram Kashyap lodged a report at Police Station, Nawagarh to the effect that on 2.3.2026 at about 10.00 pm, one Sammelal @ Nanu informed him that his son Aman Kashyap has been assaulted by accused Sharad Kashyap, Mahendra Kashyap, Gautam, Surendra, Sanjay @ Bhuru, Manju Yadav, Jyotikalash Yadav, Vikas Kashyap, Tiharu & others, due to which, he is lying unconscious. After knowledge of said incident, the complainant went to the place of incident and found that his son Aman Kashyap is lying unconscious and therefore the complainant tried to wake-up his son, at that time, the said accused persons came there, abused the complainant and assaulted with iron rod, club and other weapon, due to which, the complainant became unconscious and the accused persons fled away. After sometime, the complainant woke-up and he called his relatives and his relatives took him to the hospital for treatment. Hence, the bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that on 02.03.2026 Vinay Kashyap, Pappu Yadav, Aman Kashyap, Atul Yadav, Raja Karsh, Sarwan Karsh, Dhananjay Kashyap and Sajid Khan were abused, threatened and assaulted with the injured Gautam Yadav, due to which, he lodged 3 report at Police Station, Nawagarh, upon which, the Crime No. 81/2026 dated 02.03.2026 has been registered against the said accused persons for the offence U/s 296, 115(2), 351(3), 191(2), 109 af B.N.S., in which, they have been granted bail by this Court by order dated 29.04.2026 & 14.05.2026 in M.Cr.C. No. 3918/2026 & M.Cr.C. No. 4576/2026 respectively. The complainant party and accused party are well acquainted to each other and they have amicably settled their dispute outside the court, without any fear, protest or duress. On the similar allegations, the bail application of co-accused persons bearing M.Cr.C. (A) Nos. 1132/2026, 1189/2026 & 1268/2026 have been allowed by this Court, therefore, the applicant be released on bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail to the applicant and submits that the present matter arises out of a case and counter case. 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering the facts and circumstances of the case, and the fact that on the similar allegations the bail application of co-accused persons bearing M.Cr.C. (A) Nos.1132/2026, 1189/2026 & 1268/2026 have already been allowed by this Court, the present matter arises out of a case and counter case, grant of regular bail to the co-accused in connected counter-case by this Court vide order dated 29.4.2026 passed in MCRC No.3918/2026, 4 subsequent compromise entered into between the parties and without expressing any opinion on merits of the case, this Court is inclined to extend the benefit of anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Manju Kumar Yadav, on executing a personal bond with one surety in the like sum to the satisfaction of the Arresting Officer, he shall be released on bail on the following conditions:- (a) He should not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) He should not act in any manner which will be prejudicial to fair and expeditious trial. (c) he should appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The Applicant and the sureties shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
