Sushil Halder and others Vs. Union of India and others. ---------------
Mr. G. N. Bhattacharya. … for the petitioners.
1. The affidavit of service filed today is taken on record.
2. In spite of service none appears on behalf of the respondents.
3. The petitioners are aggrieved that the petitioners had not been considered, in spite of making an application to the concerned authority, pursuant to the order of September 21, 2011 passed by this Court in WP 7726 (W) of 2010.
4. In terms of the records, it appears that the application of the petitioners have been made on June 1, 2026 by way of a representation for reinstatement in service, to the Director General, Border Security Force.
5. There is absolutely no explanation of the interregnum period between September 2011 till June 2026. The petitioners now seek consideration of the representation of June 2026.
6. The petitioners are unable to show any application made prior to this representation of June 1, 2026. If the petitioners have failed to act in accordance with the
2
directions contained in the order of September 21, 2011 of this Hon’ble Court, the petitioners cannot seek to revive their rights anew and afresh.
7. In the circumstances afore-stated, the writ petition fails and is, accordingly, dismissed.
8. There shall, however, be no order as to costs.
9. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis.
