Learned senior advocate appearing for the petitioner submits that petitioner has been foisted with the present criminal case which is similar to another case being Salboni P.S. Case No. 264 of 2022. Additionally, it has been submitted that there is a delay in the present case for more than four years and there is no applicability of Section 409 of the Indian Penal Code. I have taken into account the materials appearing in the said case which reflects that the victims in the said case were Sovona Sarkar, Simon Hansda and Bhaskar Mahato. So far as the present case is concerned, the victim is one Mrinal Kanti Bhandari. Having considered the nature of the offence and the fact that investigation is progressing, I am of the opinion that this is not a fit case for granting anticipatory
2 bail to the present petitioner. As such, the prayer for anticipatory bail of the petitioner is rejected. The application for anticipatory bail, being CRM (A) 2093 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
