INDIRESH ORAL ORDER In these petitions, the petitioner is challenging the order dated 13th October, 2025 (Annexure-C) passed by the respondent No.2-Deputy Commissioner under Section 136(3) of the Karnataka Land Revenue Act (for short, hereinafter referred - 6 - HC-KAR CNR: KAHC010715922025 NC: 2026:KHC:42594 WP NO.33167 OF 2025 C/W WP NO.33296 OF 2025 WP NO.33322 OF 2025 to as 'KLR Act') and order dated 08th July, 2025 (Annexure-B) passed by the respondent No.3-Assitant Commissioner under Section 136(2) of the KLR Act in respect of the subject land. 2. Heard Sri. S.N. Ashwathanarayana, learned Senior Counsel on behalf of Sri. Sudhindra S.A., appearing for the petitioner; Smt. B.P. Radha, learned Additional Government Advocate appearing for respondents 1 to 4; and Sri. Madhu R., learned counsel appearing for the respondent No.5. 3. Sri. Ashwathanarayana, learned Senior Counsel appearing for the petitioner argued that the respondent- Authorities, without considering the fact that the petitioner herein is claiming right over the property in question as adopted son of K.M. Muniyappa and the Will has been executed by said K.M. Muiyappa in favour of the petitioner on 28th March, 2008, have committed an error in entering the name of the respondent No.5 in the Mutation Register. Accordingly, learned Senior Counsel sought for interference of this Court. 4. It is also submitted by learned Senior Counsel appearing for the petitioner that, immediately after the - 7 - HC-KAR CNR: KAHC010715922025 NC: 2026:KHC:42594 WP NO.33167 OF 2025 C/W WP NO.33296 OF 2025 WP NO.33322 OF 2025 impugned order dated 13th October, 2025 (Annexure-C) passed by the respondent No.2-Deputy Commissioner, the respondent No.5 had executed registered Gift Deed dated 11th November, 2025 in favour of his son Naveen Kumar and therefore, the impugned entries in the revenue records requires interference by this Court. 5. Per contra, Sri. Madhu R., learned counsel appearing for the respondent No.5 contended that, as the property in question has been gifted by the respondent No.5 to his son Naveen Kumar through a registered instrument, the petitioner herein has to approach the competent Civil Court for redressal of his grievance. Accordingly, he sought for dismissal of petitions. 6. Smt. B.P. Radha, learned Additional Government Advocate appearing for respondents 1 to 4 sought to justify the impugned orders passed by the respondent-Authorities. 7. In the light of submission made by learned counsel appearing for the parties, on careful perusal of the finding recorded by the respondent-Authorities, it is forthcoming that - 8 - HC-KAR CNR: KAHC010715922025 NC: 2026:KHC:42594 WP NO.33167 OF 2025 C/W WP NO.33296 OF 2025 WP NO.33322 OF 2025 the petitioner claims to be the adopted son of K.M. Muniyappa, however, no such Adoption Deed has been produced before the respondent-Authorities. It is also forthcoming that the petitioner herein is claiming right over the property based on the Will dated 28th March, 2008, however, in respect of the very same property another Will dated 26th May, 2017 has been executed in favour of the respondent No.5. Under these circumstances, as the respondent No.5 had executed the registered Gift Deed dated 11th November, 2025 in favour of his son Naveen Kumar in respect of the property in question, I am of the view that, no interference be called for in these petitions. Therefore, it is open for the petitioner to establish his right over the property in question in a manner known to law. Accordingly, writ petitions are rejected.
