The present writ petition has been filed in public interest praying for a direction to the respondents to construct 5 kilometer C.C. Motorable road from Ramgarh-Mukteshwar to village Bhateliya, The case of the petitioners is that in absence of a Motorable road, the villagers are facing great difficulty in transporting their produce to the Mandi Samiti. It is stated that Mandi Samiti has already proposed to make pakka road over a section 1.5 kilometer long at a cost of Rs. 24.09 lakhs. However, for the remaining part, the State Government, despite repeated requests by the villagers, has not taken any decision so far. 1 2026:UHC:2687-DB 2. Learned Standing Counsel has placed on record the instructions received from Executive Engineer, Construction Division, PWD, Nainital. The stand taken therein is that a Committee, comprising of the officials of PWD, has prepared an estimate for construction of C.C. Road in a sum of Rs. 169.50 lakhs and has recommended for sanction of Rs.8.23 lakhs in first phase. It is stated that as soon as financial approval is accorded, the construction of C.C. Road would be started. 3. Having regard to the above, we dispose of the writ petition with the observation that the respondents shall abide by the stand taken by them in their written instructions before this Court and complete the construction of road as soon as financial approval is accorded. 4.
