The Court made the following: 3 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CIVIL REVISION PETITION NO: 1613/2026 ORDER:- The Civil Revision Petition is filed under Article 227 of the Constitution of India aggrieved by the non-disposal of I.A.No.376 of 2025 in O.S.No.597 of 2025 on the file of the Court of I Additional Civil Judge (Junior Division), Ongole. 2. Heard learned counsel for the petitioner. As issuance of notices to the respondents is not necessary in this matter, hence notices to the respondents is hereby dispensed with. 3. The petitioner herein is plaintiff and the respondents herein are defendants in the suit. For the sake of convenience the parties herein are referred as arrayed in the suit. 4. Learned counsel for the petitioner submits that the plaintiff filed the suit for permanent injunction in respect of the suit schedule property. The plaintiff also filed I.A.No.376 of 2025 seeking ad-interim injunction regarding suit schedule property. After filing the said I.A., the defendants filed counter- affidavit and an advocate commissioner was also appointed to note down the physical features of the suit schedule property. Accordingly, the Advocate Commissioner submitted report. Even after submission of the report as well as completion of the pleadings, the trial Court not disposed of the I.A. even after lapse of seven months. Hence, the Civil Revision Petition. 4 5. Considering the submissions made by the learned counsel for the petitioner, it is observed that the defendants filed counter and Advocate Commissioner also submitted report. In view of the completion of the pleadings in respect of I.A.No.376 of 2025, the trial Court can conduct enquiry and dispose of the I.A. at the earliest. Therefore, the trial Court is directed to dispose of the I.A.No.376 of 2025 as early as possible after conducting a detailed enquiry as required, within a period of three(3) months from the date of receipt of copy of this Order. However, the plaintiff/petitioner herein and the defendants/respondents herein are directed to cooperate for enquiry without requesting any adjournments hereafter. 6. With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs.
