JUSTICE JAYANT BANERJI) When the matter was last listed on 18.08.2026, the following order was passed: “On the request of the learned counsel for the complainant, list the matter on 19.08.2026 to enable him to address the Court as to the provision under which the order of the Appellate Tribunal is passed, which is stated as being not complied with, and whether there is any process provided for executing such order.” - 3 - HC-KAR CNR: KAHC010544652026 NC: 2026:KHC:44728-DB CCC No. 995 of 2026 2. It is evident from a perusal of the prayer made in the contempt petition that willful disobedience of the order dated 29.06.2026 passed by the XIV Additional City Civil and Sessions Judge, Bengaluru (CCH-28) in M.A.(EAT) No.5/2024, is alleged. The order passed by the Tribunal is on an appeal under Section 94 of the Karnataka Education Act, 1983. 3. Today, the Advocate for the complainant has filed a memo for withdrawal of the contempt petition, with liberty to file an Execution Petition before the competent court. 4. The provision of moving an application for execution of the order of the Tribunal would be subject to applicable laws. The liberty sought for to file the Execution Petition therefore cannot be granted by us.
