The applicant has preferred this Second Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant as has been arrested in connection with Crime No.139/2025 registered at Police ARPAN SRIVASTAVA Digitally signed by ARPAN SRIVASTAVA Date: 2026.01.27 17:26:09 +0530
2 Station Pandri, Raipur District Raipur (C.G.), for the o9ence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The First Bail Application :led by the present applicant was rejected vide order dated 13.11.2025 in MCRC No.9106/2025. 3. Case of the prosecution, in brief, on 14.06.2025, the police of Police Station Pandri, acting upon secret information, apprehended the applicant from Daldal Siwni, Pandri, in front of the Science Centre, Irani Dera, Daldal Siwni. On conducting a search of the applicant, the police recovered 11.324 kilograms of Ganja. Accordingly, an o9ence was registered against the applicant under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act. After completing the investigation, the police :led the charge-sheet in the matter. 4. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case the applicant contends that no contraband was recovered from him, the police failed to comply with mandatory provisions of the NDPS Act, and the prosecution witnesses have not supported the case. His mother is seriously ill. He further submitted that he is in custody since 14.06.2025, the investigation is complete,
3 and the trial is likely to take time. Therefore, he is liable to grant of bail. 5. On the other hand, the learned Panel Lawyer opposes the bail application and submits that the charge-sheet has been :led in the present case before the competent Court.

It appears that applicant is the habitual o9ender, as such the applicant is not entitled to be released on bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7.
Considering the fact that from the possession of the applicant a total of 11.324 kg Ganja has been received and the present applicant has 10 criminal antecedent, and one case under the NDPS Act is also still pending, which shows that the present applicant is a habitual o9ender his involvement in several criminal activities demonstrates a pattern of repeated o9ences, raising concerns of a potential risk to public safety and the likelihood of reo9ending and he has misused the bail granted to him earlier and also in light of the judgment rendered by the Supreme Court in Deepak Yadav v. State of
5 Uttar Pradesh & Another, reported in (2022) 8 SCC 559, wherein the Hon’ble Supreme Court had cancelled the bail granted to the accused therein on the ground that the accused had previous antecedents, this Court is of the opinion that it is not a :t case to enlarge the applicant on regular bail. Accordingly, the bail application of the applicant – Zaman Ali involved in Crime No.139/2025 registered at Police Station Pandri, Raipur District Raipur (C.G.), for the o9ence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985., is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.O/ce is directed to send a certi:ed copy of this order to the trial Court concerned for necessary information and compliance forthwith. -
