In the matter of: Kushadhaj Mondal & Ors. ….petitioners
Mr. Q.A.M. Firoz, Advocate
Mr. Arun Shaw, Advocate
…for the petitioners
Mr. Abhijit Singh, Advocate
… for the State
1. It has been submitted by the learned Advocate appearing for the petitioners that the petitioners have been falsely implicated in this case due to the political enmity. It has also been submitted that the petitioners have committed no offence at all. There are allegations of snatching money assaulting in the complainant party. Nothing has been recovered from the petitioners. In such circumstances, petitioners pray for anticipatory bail. 2. Learned Advocate appearing for the State relies upon various materials in the case diary including the statements of the witnesses recorded under Section 180 of the BNSS as well as the injury report. He opposes the prayer for anticipatory bail. 2
3. From the materials-on-record, it appears that on May 16, 2026 when the complainant was returning home, the accused persons including the present petitioners restrained the complainant, abused him and forcefully took money from the complainant by putting him in fear. 4. I have also gone through the injury report contained in the case diary. Such injury report does not disclose any grievous injury on the person of the complainant. 5. From the materials in the case diary, it appears that the investigation is in final stages. 6. In such circumstances, on the basis of the materials in the case diary, I am inclined to grant anticipatory bail to the petitioners. 7.
Accordingly, I direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a Bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on condition that the petitioners will report before the Investigating Officer once in a fortnight till the conclusion of the investigation and on condition that the petitioners shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioners in Court including

cancelling the anticipatory bail granted without further reference to this Court. 8. The prayer for anticipatory bail of the petitioners is allowed. 9. C.R.M. (A) 2372 of 2026 is disposed of. (Md. Shabbar Rashidi, J.)
