Nishit Kumar Shetty, appearing for the petitioner, Sri. K. Nageshwarappa, learned HCGP appearing for respondent No.1 and have perused the material on record. 2. The petitioner is before the Court seeking the following prayer: "WHEREFORE, it is respectfully prayed that this Hon'ble Court may kindly be pleased to allow the Petition and set aside the order dated 02.07.2026, made in Crime No.30/2025 of Kota Police Station by the Principal District and Sessions Judge, Udupi in respect of Application filed by the Petitioner seeking permission to hold passport and permit him to travel abroad and permit the petitioner to hold passport and travel abroad, in the interest of justice." 3. Learned counsel for the petitioner would submit that the prayer is limited to grant of permission for issuance of - 3 - HC-KAR CNR: KAHC010495462026 NC: 2026:KHC:43060 CRL.P No. 10790 of 2026 a passport in favour of the petitioner. Learned counsel further submits that the concerned Court has rejected the application on the score that the proceedings are stayed in Criminal Petition No.2468/2025. Learned counsel submits that, if a direction is issued to the concerned Court to consider the application for issuance of a passport notwithstanding the interim order, it would suffice for the present. 4. In the light of the submission, I deem it appropriate to direct the concerned Court to consider the application of the petitioner for the purpose of grant of passport, notwithstanding the interim order granted in the aforesaid petition or its pendency, the application shall be answered in accordance with law.
