The present petition has been filed by the petitioner with the following prayer: "I. Quash and set aside the impugned order dated 03.09.2025 (Memo No. 3809/G/25-09/22/RRP-II) passed by the Office of the Chief Engineer, National Highway Zone, PWD, Raipur, whereby the contract of the petitioner has been disqualified. II. Issue a writ of Mandamus or any other appropriate writ, order or direction directing the Respondents to forthwith release the balance amount of Rs. 47,08,253/- (Rupees Forty Seven Lakh Eight Thousand Two Hundred Fifty Three only) due and payable to the Petitioner towards the approved Second Running Bill, along with applicable GST and statutory dues, within a stipulated time period; III. That this Hon’ble Court may be pleased to issue an appropriate writ, order or direction directing the Respondents to forthwith release and disburse in favour of the Petitioner the unpaid amounts towards Security Deposit (SD), Performance Guarantee (PG), and the remaining outstanding/balance payment, which are lawfully due and payable to the Petitioner, in the interest of justice. IV. Pass any other order or direction as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.” 3 3. After arguing the matter for some time, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to take recourse to law before the appropriate forum. 4. In view of the above, the present petition is dismissed as withdrawn granting liberty to the petitioner to avail the appropriate remedy available under the law.
