Appearance Mr. Snehashis Sen, Adv. …for the petitioner The Court: Affidavit of service is taken on record. Despite service, none appears for the respondent. The petitioner has preferred the present petition under Section 29A of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the arbitral tribunal to conclude the arbitral proceedings and publish the arbitral award. Learned Counsel for the petitioner submits that this Court vide order dated 15.01.2024, appointed a sole Arbitrator to adjudicate the disputes between the parties. The pleadings were completed on 23.08.2024. Thereafter, with the consent of the parties, the mandate of the arbitral tribunal was extended for six months till 23.02.2026. It is further stated that the matter is presently at the stage of examination of respondent’s witness. He further submits that the arbitral tribunal has conducted more than 11 sittings. Upon consideration of the submissions of both the parties and the materials placed on record, this Court is satisfied that there has been no 2 undue or unwarranted delay on the part of the learned sole arbitrator in conducting the proceedings. Having regard to the stage of the proceedings and in order to ensure conclusion of the arbitration, this Court deems it appropriate, in the interest of justice, that the mandate of the arbitral tribunal is extended further for a period of 10 months from the date. The learned sole arbitrator is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period.
