AUGUST 17, 2026 On 28/7/2026, following order was passed : “This is an application for condonation of delay in filing review application. The delay is of 8 days. For the reasons stated in the application and since the application is not seriously opposed, the delay is condoned. Review application be registered and processed as per rules. Misc. Civil Application St. No. 10067 of 2025 The original petitioner has filed the review application. A brief ground is regarding admitted acquisition of qualification of intermediate I.C.W.A. and entitlement for two increments. Learned counsel for the applicant has relied upon paragraph no. 12 of the order in order to buttress her contention. Since we are of the prima facie view that the petitioner- pplicant having passed intermediate examination, he would be entilted for additional increments, issue notice to the non- applicants, returnable on 17-8-2026. Mr. S. V. Purohit, learned counsel waives notice for the non-applicants.” 2026:BHC-NAG:10594-DB 46-MCA-464-2026 2 2] The Counsel for the non-applicants submits that the grounds put forth to review the judgment appear to be correct. 3] That being so, we allow the review application. The Writ Petition is restored to file. WRIT PETITION NO. 1092/2019 4] Taken on board by consent of the parties. 5] The prayer, as such, is to direct the respondents to declare that the petitioner is entitled for seven increments in the basic pay scale since the year 2011-12. The petitioner has, however, restricted the prayer to two increments. The prayer is based on the petitioner acquiring qualification of Intermediate ICWA of the Institute of Cost and Works Account, for which, admittedly, he is entitled for two increments. 6] As such, the petitioner has also claimed increments based on he acquiring MBA degree. However, the said ground is not pressed in service. 7] The Counsel for the respondents fairly submits that the petitioner is entitled for two increments on account of he acquiring qualification of Intermediate ICWA. 8] The petition is, accordingly, partly allowed. The petitioner is declared as entitled for two increments in his basic pay scale from the year 2011-12 with interest @ 7% per annum. The benefits shall be released in favour 46-MCA-464-2026 3 of the petitioner, if not already released, within four months from today. 9] The petition is disposed of in above terms.
