Gita Sinha -Vs- West Bengal State Electricity Distribution Company Limited & Ors. Mr. Abhilash Chatterjee, Mr. Saikat Dey, Ms. Najee Parvin. …. for the petitioner. Mr. Srijan Nayak, Mrs. Rituparna Maitra. ……for the WBSEDCL. Ms. Soma Ray Chaudhuri, Ms. Payel Khanra. …..for the respondent no.7. 1. The petitioner alleges inaction on the part of the respondent WBSEDCL Authorities in effecting electricity supply at the petitioner’s residential premises. 2. The petitioner submits that despite application for electricity having been applied for, the same has not been effected in favour of the petitioner. 3. Mr. Nayak, learned Advocate appearing for the respondent WBSEDCL Authorities submits that the WBSEDCL Authorities are ready and willing to effect supply in favour of the petitioner. However, they could not effect electricity supply due to objection raised by the private respondents. 2 4. Learned Advocate appearing for the private respondent no.7 submits that the petitioner has applied for electricity supply at premises no.20/2, Ghosh Para Road, Kolkata – 700120. She submits that if the electricity is supplied at premises no.20/2, Ghosh Para Road, Kolkata – 700120, then the private respondents would not have any objection, however, the petitioner should not be supplied electricity at the premises no.20/5, Ghosh Para Road, Kolkata – 700120. 5. It is thus clear that the private respondent has no objection if the petitioner is granted electricity supply at 20/2, Ghosh Para Road in terms of her application. 6. The WBSEDCL Authorities shall conduct appropriate inspection and if they find that the petitioner is in occupation of premises no.20/2, Ghosh Para Road or any portion thereof, then they shall effect supply of electricity in favour of the petitioner subject to the petitioner complying with all necessary formalities and paying all requisite charges within a period of two weeks from the date of such compliance with all formalities and payment of necessary charges by the petitioner. 7. In case any objection is raised by the private respondents or any resistance is put up in the execution of work of effecting electricity 3 supply in favour of the private respondents at premises 20/2, Ghosh Para Road, the respondent WBSEDCL Authorities would be entitled to approach the Officer-in-Charge, Titagarh Police Station seeking police assistance. If the Officer-in-Charge, Titagarh Police Station is approached by the respondent WBSEDCL Authorities in terms of this order, the said Officer-in-Charge shall afford adequate police assistance to the WBSEDCL Authorities at the costs of the petitioner. 8. It is clarified that grant of electricity supply in favour of the petitioner will not create any special right or equity in favour of the petitioner. 9. With the above observations, WPA 16197 of 2026 stands disposed of. No costs. 10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
