This petition under Section 483(1)(b) of BNSS, 2023 is filed with a prayer to relax condition No.(e) imposed by this Court in Criminal Petition No.10178 of 2026 disposed of on 15.07.2026 wherein regular bail was granted to the petitioner in Crime No.182 of 2026 registered by Yeshwantpura Police Station for offence punishable under Section 108 r/w 3(5) of BNS, 2023. 2. Heard the learned counsel for the petitioner and learned HCGP on behalf of respondent - State. 3. Petitioner herein was arrested in Crime No.182 of 2026 registered by Yeshwantpura Police Station, Bengaluru for offence punishable under Section 108 R/w 3 (5) of BNS, 2023 and seeking regular bail in the said case, he had approached this Court in Criminal Petition No.10178 of 2026, which was - 3 - HC-KAR CNR: KAHC010526702026 NC: 2026:KHC:40491 CRL.P No. 11531 of 2026 allowed on 15.07.2026 subject to certain conditions. Condition No.(e) imposed by this Court reads as follows: "The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off". Seeking relaxation of the said condition, the present petition is filed. 4. Learned counsel for the petitioner submits that, petitioner is a practicing advocate at Ernakulam District in Kerala and the impugned condition has been causing serious hardship and inconvenience to the petitioner. 5. Learned HCGP has not seriously opposed the prayer made in the petition. 6. Perusal of the order passed in Criminal Petition No.10178 of 2026 itself would indicate that petitioner is a practicing advocate in Kerala. It is not in dispute that, - 4 - HC-KAR CNR: KAHC010526702026 NC: 2026:KHC:40491 CRL.P No. 11531 of 2026 petitioner has complied all other conditions imposed by this Court in Criminal No.10178 of 2026. 7. Considering the aforesaid aspects of the matter and nature of allegations found as against the petitioner in the present case, I am of the opinion that, in the interest of justice, prayer made by the petitioner in this petition needs to be allowed. 8. Accordingly, the following:- ORDER (i) Criminal petition is allowed. (ii) The condition No.(e) imposed by this Court in Criminal Petition No.10178 of 2026 vide the order dated 15.07.2026 stands relaxed. (iii) All other conditions in the said order remain unaltered.
