I have taken into account the materials appearing in the case diary particularly the statement of the victim which speaks of penetration by sexual assault and I am surprised to see that the charge-sheet has been submitted under sections 8/12 of the POCSO Act. Although, a case under section 6 of the POCSO Act has been made out. The learned Special Court would consider the same at the time of consideration of charges. The petitioner is in custody for more than four and half months. Accordingly, I direct that the learned Special court/trial court would on the next date or within a week
2 thereafter complete the process of consideration of charges and within a period of 45 days complete the evidence of the victim. Having considered the gravity of the offence, I am not inclined to grant bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. However, the petitioner would renew his prayer for bail after the evidence of the victim is over. Accordingly, CRM (R) 64 of 2026 is dismissed. Pending application(s), if any, is also disposed of. The learned Registrar General, High Court, Calcutta is directed to communicate this order to the learned Special Court. The I.O. of the case is present in court today. His further appearance before this court for the day is dispensed with. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
