JUSTICE M.NAGAPRASANNA ORAL ORDER Heard Sri Pramoda Gowda, learned counsel appearing for the petitioner, Smt. Pramoda Gowda T.P., learned High Court Government Pleader appearing for respondent No.1, and Sri Rohan S., learned counsel appearing for respondent No.2 and have perused the material on record. 2. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have - 3 - HC-KAR CNR: KAHC010509102026 NC: 2026:KHC:39801 CRL.P No. 11088 of 2026 filed a joint affidavit along with an application. The joint affidavit reads as follows: "JOINT AFFIDAVIT " We. MASTER NAGARAJ 6 N. NAGARAJU, S/o T. Narayana, Aged about 51 years, R/at No.406, Lohith Nagar, Nelamangala, Bengaluru Rural District-562123, the Petitioner SRI ANAND R., S/o Late Ramaiah. Aged about 42 years, R/at No.9. Shivapravathi Nilaya, 3rd Cross, Sadguru Layout, Kansiram Nagar Hesaraghatta Main Road, Vidyaranyapura, Bengaluru-560097 Respondent No.2, do hereby jointly solemnly affirm and state on oath follows: 1 We state that the Petitioner is arraigned as Accused No.5 in Crime No.86/2021 registered by Gangammanagudi Police Station, Bengaluru, for the offences punishable under Sections 504 and 506 of the Indian Penal Code, 1860. After completion of the investigation, the Respondent Police filed the charge sheet and the case is presently pending in C.C. No.14778/2022 on the file of the learned XLIX Additional Chief Judicial Magistrate, Bengaluru. 2. We state that the Petitioner has filed the above Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of the proceedings in C.C.No.14778/2022 insofar as the Petitioner /Accused No.5 is concerned. Respondent No.2 is the De-facto Complainant, on whose complaint the aforesaid criminal case came to be registered. We are well conversant with the facts and circumstances of the case and are therefore competent to swear to this Joint Affidavit. 3. We state that certain disputes and misunderstandings had arisen between the Petitioner and Respondent No.2 in connection with property development and financial transactions. Owing such disputes and misunderstandings, Respondent No.2 lodged the - 4 - HC-KAR CNR: KAHC010509102026 NC: 2026:KHC:39801 CRL.P No. 11088 of 2026 complaint, pursuant which the aforesaid criminal proceedings to be initiated. 4. We state that, during the pendency of the criminal proceedings, at the intervention of our family members, relatives, friends, elders and well-wishers, have mutually decided to resolve all the disputes and misunderstandings existing between us. 5. We state that the dispute between the Petitioner and Respondent No.2 has now been amicably and finally settled. In furtherance of the settlement, both parties have agreed to put an end to the criminal proceedings insofar as the Petitioner is concerned. 6. Respondent No.2 states that, in view of the amicable settlement, he is not interested in prosecuting or pursuing the criminal proceedings against the Petitioner any further. 3. In the light of the settlement arrived at between the parties, I deem it appropriate to accept the joint affidavit and close the proceedings against the petitioner in the subject petition. 4. The crime so registered against the petitioner as well as the charge sheet so filed pursuant to the crime in C.C.No.14778/2022 stands quashed. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition is disposed. - 5 - HC-KAR CNR: KAHC010509102026 NC: 2026:KHC:39801 CRL.P No. 11088 of 2026 (ii) Proceedings in C.C.No.14778/2022 pending before the Hon'ble XLIX Addl.
