Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioners for grant of regular bail for the offences registered under Sections of 126(2), 118(1), 118(2), 117(2), 109, 308(3), 132, 352, 351(2), 351(3), 3(5) of BNS in connection with S.T No. 02 of 2026 arising out of Hiranpur PS Case No. 103 of 2025.

Learned counsel for the petitioners submits that petitioners are innocent and have not committed any offence. It is submitted that there is general and omnibus allegation against the petitioners and the co-accused, namely, Jagni Devi and Fullu Devi in B.A No. 11526 of 2025 have been granted bail vide order dated 21.01.2026 by the Co-ordinate Bench of this Court. Learned counsel for the petitioner submits that the petitioners are languishing in judicial custody since 08.10.2025 as such they may be enlarged on bail.

Learned APP opposes the prayer for bail of the petitioners.

Having regard to the fact that the co-accused in B.A No. 11526 of 2025 have been granted bail by the Co-ordinate Bench of this Court and the petitioners are lying in custody since 08.10.2025 coupled with the fact that the petitioners have no criminal antecedent, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners, above-

named, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Pakur in connection with S.T No. 02 of 2026 arising out of Hiranpur PS Case No. 103 of 2025.

It is made clear that the petitioners shall appear on each and every date before the learned trial Court and they shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioners, learned trial Court shall be at liberty to cancel the bail of the above-named petitioners.
