In view of the fact that, vide order dated 28.07.2026 passed by the Division Bench of this Court in Writ Petition (PIL) No.29 of 2026, liberty was granted to the petitioner to seek recall of the order dated 11.06.2026, the petitioner has preferred the present application pursuant to the said direction. Considering the averments made in the present Civil Application and the submissions advanced by learned advocate Mr. Japee, learned advocate Mr. Kaushal Patel, who states that he has no instructions to appear in the present miscellaneous application, and considering the fact that recall of the order is a matter between the petitioner and the Court, the order dated 11.06.2026 passed in Special Civil Application No.10807 of 2023 is required to be considered for recall. 3. Considering the fact that, in the original matter, notice had already been issued and the same was pending consideration, and that the matter was withdrawn by learned advocate Mr. Japee with a view to filing a PIL, and further considering that the Court has specifically recorded that it had not gone into the merits of the matter, I see no reason not to recall the order dated 11.06.2026 passed in Special Civil C/MCA/2126/2026(GJHC240594672026) ORDER DATED: 03/09/2026 Application No.10807 of 2023.
